Louisiana Waste Rules Face a November 4 Comment Deadline

Louisiana waste rules covering hazardous-waste text, waste-tire safeguards and permits for four types of solid-waste facilities share a written-comment deadline of 4:30 p.m. Wednesday, Nov. 4.

The Louisiana Department of Environmental Quality rulemaking ledger identifies the proposals as HW142, SW077 and SW079. Their Oct. 28 public hearings have passed, but each notice keeps written comments open through Nov. 4.

The proposals do not do the same thing. A person commenting should name the specific rule identifier rather than sending one undifferentiated statement about “waste rules.”

Louisiana waste rules open for comment

Rule Main subject Concrete proposed change Written comment deadline
HW142 Hazardous waste and hazardous materials Replaces duplicated interim-status text with cross-references and makes conforming corrections Shared deadline above
SW077 Waste tires Updates permits, financial assurance, storage and oversight provisions Shared deadline above
SW079 Solid-waste regulatory permits Creates permit standards for four specified minor processing or disposal facility types Shared deadline above

The Daily Quill built the comparison from the three notices linked by LDEQ. It is a route into the official documents, not a substitute for reading the proposal that affects a commenter.

What HW142 would change

HW142 concerns nine hazardous-waste chapters. LDEQ says Chapter 43 accumulated duplicated language as it was amended over decades. The proposal would replace the full text of 45 sections with cross-references, repeal 11 sections whose requirements appear elsewhere and make other conforming corrections.

The agency says the obligations would continue through the cited standards. The proposal is therefore about the structure and maintenance of the rule text rather than an announced removal of the underlying contingency, manifest or recordkeeping duties.

What SW077 and SW079 would change

SW077 proposes a broader revision of Louisiana’s waste-tire regulations. The notice says permit terms for processing and collection facilities would move from five years to 10 years. It also proposes more detailed modification submissions and higher closure-cost financial assurance.

The fiscal statement lists proposed closure-cost figures of $105 per ton for waste tires and waste-tire material and $652 per ton for off-road tires weighing more than 500 pounds, replacing a $20-per-ton figure last updated in 1994. Those are proposed regulatory figures, not a consumer disposal price.

SW079 would establish regulatory permits for air-curtain destructors, grease-processing facilities, separation facilities and injection-well processing facilities. LDEQ describes the permit route as less burdensome than a standard Type III permit for those specified minor facilities.

How to submit a comment

Each notice instructs commenters to reference its identifier. Written comments may be sent to the LDEQ Legal Affairs Division by the postal address, fax number or email listed in the official notice. The notices identify the email as DEQ.Reg.Dev.Comments@la.gov and the fax as 225-219-4068.

A useful comment can identify the exact section, explain the operational or public consequence and provide supporting records. Commenters addressing more than one proposal should clearly separate HW142, SW077 and SW079 so the agency can associate each point with the correct docket.

The deadline is receipt by 4:30 p.m., not merely a general Nov. 4 postmark statement. Anyone using postal delivery should account for transit time or use another method allowed by the notice.

For a facility operator, the three Louisiana waste rules call for different evidence. A hazardous-waste commenter may focus on whether a cross-reference preserves a duty clearly. A tire processor may compare the proposed financial-assurance amount with documented closure costs. An operator covered by SW079 may address whether the new regulatory-permit conditions fit the facility type named in the proposal.

That separation matters because the Louisiana waste rules sit in different dockets even though the clock is shared. A comment that cites a section, explains the operational effect and attaches a relevant record gives LDEQ a more specific issue to answer than a general objection.

Readers can follow related deadlines through The Daily Quill’s Science and Environment desk. After Nov. 4, the useful next record will be LDEQ’s response or final-rule publication; until then, the three proposal documents remain the authoritative source for the text under consideration.
